Earliz.com is a website of communication and collaborative organization that enables users to connect with a network of members (your "Network") and to create some organization spaces (the "Projects"). The user has access to an instant messenger service with its direct contacts and the members of its projects. The generated data on the website is instantly shared with autorized people of your network (see Personal Data). In accordance with internet practice and custom, advertisements may be incorporated into the Website.

2. Our liability as host

We are under no legal obligation to monitor content transmitted via or stored on the Website. Our only obligations as host concern the fight against certain content in accordance with the procedure described in the Prohibited Content section, the retention of your connection data, which is subject to our policies on Personal Data, and the removal of all clearly illegal content which has been effectively brought to our attention.

3. Your liability as user

By uploading or disseminating content (articles, notes, lists, comments on them or your avatar) to or through the Website, you have to respect current legal provisions and laws. You warrant to not expose Earliz against any complaint or lawsuit by a third due to your use of the service, signed with your username and password, which will not comply with this Terms or any other policy of Earliz. This warranty include any amount Earliz would be required to pay for any purpose, including attorney fees and court costs.

Earliz does not offer any warranty on the use of the service, including its availability despite the technical architecture and efforts of Earliz to ensure it.

5. Registration and access

In order to use many of the Website's features, you must set up an account using the online registration form. You are free to modify the Prohibited Content section, the retention of your connection data, which is subject to our policies on Personal Data you provide on the form at any time. As a member of the Website, you have the responsability to validate your personal data are true and complete. You may access your account by entering your username and password in the login fields. You alone are responsible for keeping your username and password secure. Registration entitles you to use the Website. We reserve the right to terminate your account at any time. Failure to comply with the Terms or any other policy of Earliz may result in access to your personal page being temporarily or permanently suspended, immediately and without notice, or in the deactivation of your account, without prejudice to any other rights we may have.

6. Paid subscription

If you subscribe to a paid subscription, you agree that the period associated with the chosen plan is the commitment period. You can always upgrade your subscription to a higher plan, but no downgrading of your plan will be accepted even if your commitment period is over. All upgrades will be for a period going at least until the end of your commitment period. You retain your rights to cancel your subscription and delete your data but no refund can be claimed to Earliz. As well if you violate your obligations explained in these Terms, we reserve the right to terminate your subscription without refund or other financial consideration.

7. Availability of the Website

The Website is in principle available 24/24h, 7/7d, except interruption, planned or unplanned, for the purposes of his maintenance or special emergency. We are making all efforts to provide the service, and so we can not be held responsible for any damages, whatever their nature, resulting from the unavailability of the Website.

You understand and agree that Earliz may stop (permanently or temporarily) providing the Service (or any features of the Service) to you or all users at the sole discretion of Earliz without notice to you before.

8. Copyright

The general structure of the Website and any other component (such as including graphic, text, images, photographs, logos, domain names) are the exclusive property of Earliz or have been subject to prior authorization of use for the benefit of Earliz.

Any reproduction or representation of all or part of the Website and/or component by any means, without the express permission of Earliz are therefore forbidden and would constitute a counterfeit sanctioned by articles L. 335-2 of the Code of Intellectual Property.

9. Update of the Website

Earliz has the right to change its services or the Site including the provision of new features or modifying and/or deleting features that are available to date from the site.
